1. Who provides this service

Promptary is operated by b4analytics, a sole proprietorship (ZZP) registered in the Netherlands. References to "we", "us", or "Promptary" refer to b4analytics.

2. What Promptary is

Promptary is a web-based prompt engineering workspace. It allows you to write, organize, and serve AI prompts via a REST API. We provide the platform; you provide the content.

3. Your account

• You must be at least 16 years old to create an account
• You are responsible for keeping your password secure
• You are responsible for all activity that occurs under your account
• One person may not maintain multiple free accounts to circumvent plan limits
• You must provide a valid email address and keep it up to date

4. Acceptable use

You may use Promptary for any lawful purpose. You may not use it to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Generate, store, or distribute harmful, abusive, or illegal content
• Attempt to gain unauthorized access to Promptary systems or other users' accounts
• Resell or sublicense access to the Promptary API without our written permission
• Abuse the API in ways that degrade service for other users

5. Your content

You own all prompts and content you create in Promptary. We do not claim any ownership over your content.

By using Promptary, you grant us a limited license to store and serve your content solely for the purpose of providing the service to you.

We do not use your content to train AI models. We do not sell or share your content with third parties.

6. Paid plans and billing

• Paid plans (Developer and Team) are billed monthly or annually in advance
• Payments are processed by Stripe. We do not store your payment card details
• Prices are shown excluding VAT. VAT is added at checkout based on your location
• You may cancel your subscription at any time via the billing portal in the app
• On cancellation, your plan remains active until the end of the current billing period
• We do not offer refunds for partial billing periods except where required by law
• We reserve the right to change pricing with 30 days notice to existing subscribers

7. Free plan

The Personal plan is free and has no time limit. We reserve the right to modify free plan features with reasonable notice. We will never charge you without your explicit consent.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses caused by downtime, data loss, or service interruptions.

We perform maintenance and may take the service offline briefly. We will try to give advance notice for planned maintenance.

9. API usage

• API keys are personal and must not be shared publicly or committed to public repositories
• API access is rate-limited to 60 requests per minute per key
• We reserve the right to revoke API keys that are abused or shared publicly
• Prompt IDs are stable — we will not change them without notice

10. Termination

You may delete your account at any time by contacting us at evkhv67@gmail.com. Your data will be purged within 30 days.

We may suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

11. Limitation of liability

To the maximum extent permitted by Dutch law, b4analytics is not liable for indirect, incidental, special, or consequential damages arising from your use of Promptary.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.

13. Changes to these terms

We may update these terms. We will notify registered users by email for material changes and update the "Last updated" date above. Continued use of Promptary after changes constitutes acceptance.
